We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a security risk to our platform or other users.

All site content, branding, and product features are owned by BrainRash or our licensors. Courses created by instructors remain their property but grant BrainRash distribution rights.

You may not copy, redistribute, or create derivative works without written consent. Limited screenshots for reviews or academic work are acceptable with attribution.

The BrainRash platform, including its design, functionality, code, graphics, logos, and all other content, is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our platform without our prior written consent.

Completing a course does not guarantee employment, licensure, or external accreditation. Certifications issued by BrainRash reflect our evaluation criteria and can be revoked for misconduct or fraud.

AI-assisted coursework is monitored. We reserve the right to request re-submission or additional verification.

Learning is always free. Optional premium upgrades, creator tools, or swag purchases are billed in advance via Stripe.

Refunds: 14-day window if you have consumed less than 25% of the paid feature or course. Token bonuses earned during the refunded period may be reversed.

We can suspend or close accounts for policy violations, security risks, or inactivity affecting platform health. You will receive email notification whenever possible.

Upon termination your access ceases immediately, but you may export personal data within 30 days unless restricted by law.

BrainRash is not liable for indirect, incidental, special, consequential, or punitive damages related to your use of the platform.

Our total liability is limited to fees you paid to BrainRash in the 12 months preceding the claim.

To the maximum extent permitted by applicable law, BrainRash and its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the platform.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitations may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

We revise terms as we ship new features. Substantive changes trigger in-app banners and email notices. Continued use after the effective date means you accept the updates.

Any disputes arising from or relating to these Terms or your use of BrainRash will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

You waive any right to participate in a class-action lawsuit or class-wide arbitration against BrainRash. Any arbitration will be conducted on an individual basis only.

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in San Francisco County, California, and you hereby consent to the personal jurisdiction and venue of such courts.
